Association Operations under the 2009 Amendments to Common Interest
Ownership Act

& McCracken will hold four seminars for the officers and directors
of our client associations in April. A flyer for the seminars is
available by clicking here. At each of these seminars, our
attorneys will discuss how the 2009 amendments to the Common Interest
Ownership Act or “CIOA” will
affect the operations of community associations, and they will discuss
steps community associations can take to comply with the new
requirements. We will provide attendees with information and materials
about:

New requirements for calling & holding meetings,
including the new open meeting requirements
·
Changes to resale certificates
·
New insurance requirements

Matt Perlstein and
Greg McCracken were selected as Connecticut Super Lawyers for 2010. Super Lawyers magazine names
attorneys in each state who received the highest point totals, as

Matt Perlstein is listed
in the current edition of The New York Area’s Best Lawyers,
a guide to legal representation in New York,
New Jersey, and Connecticut. He also is listed in
the 2007, 2008, and 2009 editions of The Best Lawyers in America.
Best Lawyers is the oldest and most respected peer-review
publication in the legal profession. Because lawyers are not required
or allowed to pay a fee to be included, a listing in Best Lawyers
is regarded within the legal profession as a significant honor
conferred on a lawyer by his or her peers.
Matt Perlstein
chaired a panel of attorneys that presented a seminar on March 11,
2010, for the Connecticut Bar
Association (“CBA”). The seminar focused on the recent
amendments to the Common Interest Ownership Act. Many Connecticut attorneys, whose
practices include the representation of associations, unit owners or
developers, attended this seminar, as did a number of community
association managers. The written materials from the seminar have been
compiled into a publication available to members of the CBA and the general public.
Scott Sandler has
been appointed chairman of the Legislative Action Committee of the the Connecticut
Chapter of the Community
Associations Institute. The Committee is responsible for organizing
the advancement of legislation to protect the interests of associations
and unit owners, and the opposition of any legislation that is harmful
to those interests. Scott served as a member of the board of the
Chapter from 2004 through 2009, and is a past president of the Chapter.
In 2009, Matt
Perlstein, Scott Sandler, and Greg McCracken served on the Study
Committee of the Connecticut Law Revision Commission, which reviewed
and revised the 2008 amendments to the Uniform Common Interest
Ownership Act. Scott covered issues and concerns of the Connecticut
Chapter of the Community Associations Institute, and Greg covered
issues and concerns of the Home
Builders Association of Connecticut, Inc.
Recent Events
Perlstein, Sandler
& McCracken, LLC hosted a booth at the 2010 condo/HOA conference and expo, presented by the
Connecticut Chapter of the Community Associations Institute on March
13, 2010 in New Haven. The theme of the conference and expo was
“Condo Survivor.” Matt Perlstein, Scott Sandler, Greg
McCracken, and Larry Malick attended the conference and expo. They
enjoyed the opportunity to again see many of the firm’s existing
clients and colleagues and to introduce themselves to homeowners in
communities that the firm does not yet represent. The conference and
expo included seminars concerning issues currently facing community
associations, and Matt, Scott, and Greg participated in them.
Matt Perlstein and
Scott Sandler attended the 31st Annual Community Association Institute
Law Seminar on January 21 and 22, 2010, which the College of
Community Association Lawyers presented in Tucson, Arizona.
There were numerous seminars discussing legal issues facing
associations throughout the United States, with an
opportunity for them to share knowledge and experiences with other
attorneys and professionals who are interested in community association
law.
